Why Mediation?

Mediation is cost effective, confidential and a much quicker method of resolving legal disputes than being engaged in, or continuing with a protracted Court battle.

The Mediator is a 3rd party neutral whose role is to facilitate discussions, manage the process and help parties to move towards settlement.

Mediation allows parties to enter into creative solutions, avoid Court proceedings or bring proceedings to a timely and cost effective conclusion.

Types of Dispute

We offer mediation for the full range of civil and commercial disputes including:-

  • Contractual disputes;
  • Contested probate/Inheritance issues;
  • Farming disputes;
  • Partnership / Company disputes;
  • Landlord/Tenant issues;
  • Employment issues;
  • Property disputes to include TOLATA claims and other land and property based claims;
  • Professional negligence;

The Mediation Process

The mediation process typically takes place over one day. Once you have appointed your mediator then terms are agreed and the date for and the venue of the mediation is set.

On the day of the mediation, parties and representatives have an opening session with the mediator and then a number of private sessions with the mediator over the course of the day as discussions progress. Discussions are confidential / without prejudice until such time as an agreement is reached and that agreement is drafted and signed by all parties.

The process allows parties to negotiate in more of an informal and relaxed setting than a Court building and allows parties to retain control of the decision making process.

We offer face to face and on-line mediation and are flexible in terms of venue and travel.

Mediation Costs

We offer a daily rate to include preparation time.
